Questions from this subtopic
Each one with the model answer underneath.
- 1
Name four distinct torts recognised in English law.
Model answer
Negligence, private nuisance, trespass to land and defamation are four distinct torts. Each tort has its own elements that a claimant must prove.
- 2
Which interests does the tort of negligence mainly protect?
Model answer
Negligence mainly protects against physical injury to the person and damage to property. Purely economic loss and psychiatric injury are recoverable in negligence only in narrower circumstances.
- 3
Which interest does the tort of private nuisance protect?
Model answer
Private nuisance protects the use and enjoyment of land. The tort balances one landowner's activity against a neighbour's comfort.
- 4
Which torts protect a person's reputation?
Model answer
Libel and slander, which together make up defamation, protect reputation. The Defamation Act 2013 requires the claimant to show serious harm to reputation.
- 5
Name the three trespass torts.
Model answer
Trespass to the person, trespass to land and trespass to goods are the three trespass torts. All three are actionable without proof of damage.
- 6
Define the phrase actionable per se and give a tort that is.
Model answer
A tort actionable per se requires no proof of damage at all. Trespass to land is actionable per se, so a bare entry can be sued on.
