Each one with the model answer underneath.

  1. 1

What is the Equality and Human Rights Commission?

    Model answer

The Equality and Human Rights Commission promotes and enforces equality and human rights law in Great Britain. The Equality Act 2006 created the Commission. Work began in 2007.

  2. 2

Which bodies did the Commission replace?

    Model answer

The Commission took over the functions of the separate commissions for racial equality, sex equality and disability rights. A single body was created to cover every protected characteristic and human rights as well.

  3. 3

What is the Commission's general duty?

    Model answer

The Commission must encourage a society in which prejudice does not limit what people achieve. Discrimination must be eliminated and equality of opportunity advanced. Promoting understanding of and respect for human rights forms part of the same duty.

  4. 4

What enforcement powers does the Commission hold?

    Model answer

The Commission may conduct inquiries and formal investigations, issue unlawful act notices and enter binding agreements. The Commission may also apply for an injunction to restrain persistent unlawful conduct.

  5. 5

How does the Commission support individual litigation?

    Model answer

The Commission may provide legal assistance to an individual bringing a discrimination or human rights claim. The Commission may also intervene in a case as a third party to make submissions on the law.

  6. 6

Why is the power to intervene significant?

    Model answer

Intervention allows the Commission to put the wider public interest before a court in a case brought by a private individual. The court receives argument on the general legal question rather than only on the parties' positions.
