How useful is the short title?
Questions from this subtopic
Each one with the model answer underneath.
- 1
Define an intrinsic aid.
Model answer
An intrinsic aid is material inside the Act itself that helps a judge decide what a provision means. Long titles, preambles and interpretation sections are examples.
- 2
How does the long title help interpretation?
Model answer
The long title states in general terms what the Act is designed to do. Judges use the long title to identify the general purpose of the legislation.
- 3
How useful is the short title?
Model answer
The short title is only a convenient label for citing the Act. The short title carries little interpretative weight because it is too brief to reveal the purpose.
- 4
What is a preamble, and where is one found?
Model answer
A preamble is an opening passage explaining the reasons for the Act and the mischief it addresses. Preambles are common in older statutes and rare in modern ones.
- 5
What is an interpretation section?
Model answer
An interpretation section is a provision inside the Act that defines terms used in it. The definition binds the court whatever the ordinary meaning of the word might be.
- 6
Give an example of an Act with an important interpretation section.
Model answer
The Theft Act 1968 defines dishonestly, appropriates, property and belonging to another in its opening sections. The statutory definitions control how the offence of theft is applied.
