- 1
What is the custody threshold?
Model answer
A custodial sentence is available only where the offence is too serious for a fine or a community order. The Sentencing Act 2020 states this threshold.
- 2
What is a suspended sentence order?
Model answer
A suspended sentence order imposes custody of up to three years but suspends it for an operational period of up to two years, or up to three years where the custodial term is over two years. Breach of a requirement or a further offence normally activates the custody.
- 3
What is a determinate sentence?
Model answer
A determinate sentence is a fixed term of imprisonment set by the court. An offender normally serves part of the term in custody and the rest on licence.
- 4
What is a life sentence?
Model answer
A life sentence lasts for the offender's whole life, with a minimum term set before release can be considered. The Parole Board then decides release and the offender remains on licence.
- 5
What is a whole life order?
Model answer
A whole life order means the offender will never be released. Whole life orders are reserved for exceptionally serious murders.
- 6
What is a community order?
Model answer
A community order is a non-custodial sentence made up of requirements chosen by the court. Unpaid work, curfews, treatment and rehabilitation activity are common requirements.
