Questions from this subtopic

Each one with the model answer underneath.

  1. 1

What does section 6 of the Human Rights Act provide?

    Model answer

Section 6 makes it unlawful for a public authority to act in a way incompatible with a Convention right. The duty is the operative obligation created by the Act.

  2. 2

What is a core public authority?

    Model answer

A core public authority is a body whose functions are wholly public, such as a government department, a local authority, the police or the armed forces. Every act of a core public authority is bound by section 6.

  3. 3

What is a hybrid public authority?

    Model answer

A hybrid public authority is a body some of whose functions are of a public nature. The body is bound only in respect of its public functions, and not in relation to its private acts.

  4. 4

Why has the definition of a public authority caused difficulty?

    Model answer

Public services are increasingly delivered by private and charitable providers under contract. Courts have had to decide whether such a provider exercises a public function, and the case law has drawn the line narrowly in some contexts.

  5. 5

Is a court a public authority?

    Model answer

A court is expressly a public authority for the purposes of the Act. A court must therefore act compatibly with Convention rights, which is the route by which the Act reaches private disputes.

  6. 6

Is Parliament a public authority under the Act?

    Model answer

Parliament is expressly excluded. The House of Lords in its former judicial capacity was once an exception, but that provision was repealed when the Supreme Court took over its judicial role. The exclusion protects parliamentary sovereignty and privilege.
